I recently noticed some leaking on the inside of my bay windows. I own a new construction that is less than 10 years ago. One contractor I got to inspect the tin roof over the bay window says that it was installed incorrectly without flashing and they used some caulking material on the top which should never have been used. Is this true? I had my home owner insurance come out to look at property and told me that the area just need to be sealed better at the vents with caulking but it is not covered due to workmanship issue.

What are my recourse at this point? It is under 10 years. Should I go after the original construction company.

Linda, I would review the warranty you received from your builder. It should spell out whether this is covered under warranty. There are different levels of workmanship quality "out there" ... regardless, you can engage the contractor in conversation to see if they can help with this. There are some situations where flashing is in place but not overtly visible.
